1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the sleepmx platform and services (collectively, the "Service"), operated by Zurcloud Consulting LLC ("we", "us", or "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. The Service

The Service provides a dashboard for analyzing CPAP therapy data, including sleep stages, pressure statistics, event markers, and related metrics. The Service is provided "as is" and we may modify or discontinue features at any time.

3. Accounts

To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

4. Your Data

You retain all rights to the data you upload to the Service, including your CPAP session data. By using the Service, you grant us a limited license to process, store, and display your data solely to provide the Service to you. Health-related data is processed in accordance with our Privacy Policy.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable law;
• Upload data that you do not have the right to upload;
• Attempt to gain unauthorized access to the Service, other accounts, or related systems;
• Interfere with or disrupt the integrity or performance of the Service;
• Reverse engineer, decompile, or attempt to extract the source code of the Service.

6. Not Medical Advice

The Service is a data analysis tool and is not a medical device. It does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional regarding your therapy and health decisions.

7. Intellectual Property

The Service, including its software, design, and content, is owned by Zurcloud Consulting LLC and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, Zurcloud Consulting LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. You may delete your account and data at any time.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page with an updated date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law provisions.
